Terms of Service
1. Agreement
By creating an account or using LevelUp360HQ ("LU360", "the Service"), you agree to these Terms. If you don't agree, please don't use the Service.
The Service is operated by [TBD: legal entity name] ("we", "us"). Our Privacy Policy explains how we handle your personal data and forms part of these Terms.
2. Who can use LU360
- You must be at least 16 years old to create your own account on LU360.
- A parent or legal guardian must create the account on behalf of any child under 16.
- Coaches and club admins must be authorised by the football club / sports organisation they represent.
- You agree to provide accurate information and to keep it up to date.
3. Your account
- One account per person. Don't share login credentials.
- You're responsible for everything that happens under your account. If you think someone else has accessed it, change your password (or request a new sign-in link) and email us immediately at security@levelup360hq.com.
- You can delete your account at any time from your account settings. The deletion removes your personal data per the Privacy Policy.
4. Children's accounts
Athlete records belong to a club, but the parent or guardian who signs up controls visibility, photo uploads, and sharing on behalf of the child. As an athlete turns 16 they can take ownership of their own profile if they choose to create their own account.
Coaches and club admins can record match results, mark attendance, and award XP for athletes in their club. They cannot delete an athlete's history without parental consent.
5. Content you upload
You keep ownership of everything you upload — photos, names, notes, comments. By uploading, you grant LU360 a non-exclusive, royalty-free licence to store, display, and process that content as needed to run the Service.
You promise that:
- You have the right to share whatever you upload (e.g. a photo of your own child, or one you have permission to use).
- You won't upload illegal, harmful, harassing, or rights-infringing content.
- You won't use the Service to bully, dox, or harass another user.
We may remove content that breaks these rules and, in serious cases, suspend or terminate the account that uploaded it.
6. Acceptable use
You agree not to:
- Attempt to break into other users' accounts
- Scrape, crawl, or harvest data from the Service without permission
- Reverse-engineer the platform or bypass security controls
- Use the Service to send spam or distribute malware
- Resell access to the Service without a written agreement
- Submit false or inflated stats to game the leaderboard or tier system
7. Service availability
We aim to keep LU360 available 24/7 but we can't guarantee uninterrupted service. We may take the platform offline for maintenance or updates and will give reasonable notice when we can. Push notifications and emails depend on third-party services (browsers, mobile OS, email providers) and may occasionally be delayed or undelivered through no fault of ours.
8. Pricing & plans
Some features may require a paid subscription. Pricing is shown in the app before you subscribe. You can cancel any time; cancellation takes effect at the end of the current billing period and no refunds are issued for unused portions of a period unless required by law.
Free-tier features remain available to all users for the foreseeable future. We'll give 30 days' notice if a free feature is moving to a paid plan.
9. Termination
- By you. Delete your account from settings whenever you like.
- By us. We may suspend or terminate accounts that repeatedly breach these Terms, on reasonable notice except in cases requiring immediate action (illegal activity, security threats, safeguarding concerns about children).
- On termination your data is handled per the Privacy Policy — generally, personal data is removed within 24 hours; anonymised business records (matches recorded, news posts authored) remain with the club.
10. Disclaimers
LU360 is provided "as is". We don't guarantee the Service will be error-free or that the data on it is perfectly accurate (especially for stats that depend on coaches and parents entering them correctly). Tier levels, XP scores, and badges are gamification mechanics for fun and engagement, not professional sports assessments.
Where the law allows, we exclude all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by law:
- We're not liable for indirect or consequential losses (lost opportunities, lost data beyond what we can reasonably restore, hurt feelings about leaderboard rankings).
- Our total liability to you in any 12-month period is capped at the greater of (a) £100 or (b) the amount you actually paid us in that period.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited by law.
12. Governing law
These Terms are governed by the laws of England and Wales. Any dispute will be resolved exclusively in the courts of England and Wales, unless local consumer protection law gives you a right to bring a claim in your country of residence.
13. Changes to these Terms
We may update these Terms. If a change is material we'll notify you by email or an in-app banner before it takes effect. Continued use after a change means you accept the new version.
